Yes, in most cases. A Texas notary can notarize a power of attorney when the signer appears before the notary, shows valid photo ID, and is signing willingly and with understanding. Does the signer need to be mentally competent to have a document notarized?
Yes. A notary can only notarize for a signer who is present, willing, and aware of what they are signing. A notary cannot diagnose or certify mental capacity, and cannot proceed if the signer does not appear to understand the transaction.
Does a mobile notary provide witnesses?
It depends on the document. Notarization and witnessing are separate requirements, and some documents, such as a Texas will, need two witnesses in addition to the notary. Tell us the document type when you book so we can confirm what it requires and plan for any witnesses before the appointment.
Can a notary refuse a notarization?
Yes. Texas notaries are required to refuse a notarization if the signer cannot provide proper ID, does not appear to understand what they're signing, appears to be under duress, or if completing the notarization would violate Texas notary law.
