When a child under 16 applies for a U.S. passport, both parents or legal guardians are normally expected to appear together. When one of them cannot, that parent completes Form DS-3053, Statement of Consent, and signs it in front of a notary. When Form DS-3053 is needed

It applies to passport applications for a child under the age of 16. If both parents or legal guardians can appear with the child, the form is not needed. If one cannot, the non-applying parent or guardian completes DS-3053 and has the signature notarized; it is then submitted together with the child's Form DS-11 application at an acceptance facility.

The 90-day clock most families miss

A notarized statement of consent expires 90 days after the date of notarization — it must reach the passport application within three months of the day it was signed. This is the single most common reason a DS-3053 is rejected. If your passport appointment is months out, notarize closer to the appointment, not as soon as you fill out the form.

What to have ready

Bring the DS-3053 filled out but not yet signed, and a valid government-issued photo ID for the signing parent or guardian. A photocopy of the front and back of that same ID is submitted with the form, so make sure the ID you show the notary is the ID you copy.

If the consenting parent is not in Texas

This is the most common situation we see — a parent stationed elsewhere, working out of state, or living abroad. We hold a Texas online notary commission, so in many cases that parent can appear by video and sign remotely. Before going that route, confirm the acceptance facility handling the application will accept a remotely notarized DS-3053.

How long is a notarized DS-3053 valid?

It expires 90 days after the date of notarization, and must be submitted with the child's application within three months of being notarized. Schedule the notarization close to the passport appointment so it doesn't lapse. If it expires, the consenting parent has to sign and notarize a new form.

Can I sign it before the notary arrives?

No. The consenting parent must sign the DS-3053 in the notary's presence. Bring it completed but unsigned, along with the valid government-issued photo ID whose front and back you will photocopy for the application. If it was already signed, print a fresh copy and sign it at the appointment.

Do you supply the DS-3053 form?

No. The DS-3053 Statement of Consent comes from the U.S. Department of State; download it from their website. Fill it out but do not sign it before the appointment. We notarize the consenting parent's signature on the copy you bring, after checking their valid government-issued photo ID.

What identification does the signing parent need?

A valid government-issued photo ID. A photocopy of the front and back of that ID is submitted with the form, so the ID shown to the notary should be the one you copy.

Can the out-of-state parent sign by video?

Often, yes. We are commissioned as a Texas online notary, so an out-of-state parent can sign the DS-3053 statement of consent by video through remote online notarization. Confirm first that the passport acceptance facility handling the application accepts a remotely notarized statement of consent, then book the session.
